Terms of Service

By accessing or using the Service, creating an account, or making a purchase, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind it to these Terms.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the consent and involvement of a parent or guardian, who agrees to these Terms on your behalf. You must not use the Service if you are barred from doing so under any applicable law.

• You sign in through a third-party provider (Google, Discord, GitHub, email link or Telegram). You are responsible for keeping access to that provider secure.
• You are responsible for all activity that happens under your account.
• You agree to provide accurate information and to keep it up to date.
• One person may not maintain accounts to abuse leaderboards, rewards, promotions or the economy.
• Notify us promptly at support@chillgame.online of any unauthorised use of your account.

When using the Service — including chat, voice, video, usernames, profiles and any other content — you agree not to:

• Harass, threaten, bully, defame or harm other players, or incite others to do so.
• Post or transmit content that is illegal, hateful, sexually explicit, or that exploits or endangers minors.
• Cheat, exploit bugs, use bots/automation, manipulate XP, leaderboards or the in-game economy, or otherwise gain an unfair advantage.
• Impersonate others or misrepresent your affiliation with any person or entity.
• Attempt to access, disrupt, overload, reverse-engineer or compromise the Service or its infrastructure.
• Infringe anyone's intellectual property, privacy or other rights.
• Use the Service for spam, fraud, money laundering, or any unlawful purpose.

We may remove content and suspend or terminate accounts that violate these rules, with or without notice.

“Your content” means anything you submit through the Service — your username, display name, bio, uploaded avatar, chat messages, and your live voice and video. You retain ownership of your content. You grant Chillgame a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and transmit your content solely to operate and provide the Service (for example, showing your profile to others or relaying your voice to other players in your room).

You are solely responsible for your content and confirm you have the rights to share it. We do not claim ownership of it, and we do not record your voice or video streams. We may remove content that violates these Terms or the law.

The Service may offer in-game currency (“Coins”), cosmetic items, pets, passes and other digital goods (“Virtual Items”). The following applies to all Virtual Items:

• Virtual Items are a limited, personal, non-transferable, revocable licence to use a feature of the Service. You do not own them.
• Virtual Items have no real-world monetary value, cannot be exchanged for cash, and cannot be sold or traded outside the Service except where we expressly allow it (such as gifting a pass to a friend).
• We may change, re-balance, suspend or remove Virtual Items, prices and the economy at any time to keep the Service fair and sustainable.
• All anti-cheat rules apply: currency and items are granted and spent only on our servers. Attempts to fabricate balances or duplicate items may result in forfeiture and account action.
• If your account is terminated for breach of these Terms, your Virtual Items are forfeited without refund.

Paid plans (such as Plus, Pro and Ultra), add-ons, GamePass and Coin purchases are sold and processed by Whop, our payment provider and merchant of record. By purchasing, you also agree to Whop's terms. Applicable taxes are handled by the merchant of record.

Recurring subscriptions. Paid plans (Plus, Pro, Ultra) and any add-on sold on a recurring basis are subscriptions:

• They renew automatically at the end of each billing period at the then-current price until you cancel.
• You can cancel at any time; cancellation stops future renewals and your plan benefits continue until the end of the current paid period.
• Where a plan includes a free trial, the plan price is charged automatically when the trial ends unless you cancel before it does.
• We may change prices and plan features. We will give reasonable notice of price changes, which take effect at your next renewal.
• If a payment fails, we may downgrade or suspend the paid benefits of your account.

One-time purchases. GamePass and Coins are one-off purchases, not subscriptions:

• GamePass is a single, per-season purchase. It unlocks the current season's benefits and stays active until that season ends or rotates — it does not renew automatically, and you are not charged again when a new season begins.
• Coins are purchased once and added to your balance for use on Virtual Items (see Virtual items & in-game currency).

Except where required by law or expressly stated, payments are non-refundable, and Virtual Items or plan time already consumed are not refundable. Statutory rights of withdrawal (for example, the EU 14-day right for digital content) may apply; note that by starting to use digital content immediately you may waive that right where the law permits. Refund requests are handled by our merchant of record, Whop; contact us at support@chillgame.online and we will help.

Donations are voluntary contributions to support the Service and are non-refundable. Any perks associated with donating (such as recognition or cosmetics) are provided at our discretion and may change. A donation is not a purchase of any specific good or service.

The Service — including its software, game designs, text, graphics, logos, the Chillgame name and all related content (other than your content and third-party content) — is owned by Chillgame or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial entertainment. You may not copy, modify, distribute, sell or create derivative works from the Service except as allowed by law or with our written permission.

The Service relies on and links to third-party services (sign-in providers, our payment provider, real-time voice/video, hosting and community platforms such as Discord). We are not responsible for third-party services or content, and your use of them is governed by their own terms and privacy policies.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the maximum extent permitted by law, Chillgame and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising from your use of (or inability to use) the Service. To the extent we are found liable, our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Chillgame and its operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of any law or third-party right.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends and unused Virtual Items may be forfeited as described above. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability and indemnification) will survive termination.

We are constantly improving the Service and may add, change or remove features at any time. We may also update these Terms; when we make material changes we will update the “Last updated” date and, where appropriate, notify you in the product. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws applicable at our principal place of operation, without regard to conflict-of-laws rules, and unless mandatory consumer-protection laws of your country of residence provide otherwise. You agree to first try to resolve any dispute with us informally by contacting support@chillgame.online. If we cannot resolve it, the dispute will be handled by the competent courts of our place of operation, subject to any mandatory rights you have as a consumer to bring proceedings in your home jurisdiction.
